10.    Review of Submission Waivers before the Board:

a.       Case No. SP-1133 / Archangel Michael Coptic Orthodox Church

                     i.       Type:  Preliminary and Final Site Plan

                   ii.         Description:  seeking approval to keep the existing church building and facility while demolishing the existing residential dwelling on lot 32.01 to construct a 2-story, 28,690 sf accessory multi-purpose building to the church.  The new building will contain religious classrooms, day care, adult day care, a gymnasium, and more.  They are also proposing a 336 sf gazebo and 3,200 sf shelter building in the rear of the new building, and a new soccer field with lights and a basketball court on the south side of the lot.  They will also be expanding the parking lot with 58 new parking spaces and a new 20-foot wide gravel fire access driveway from Church Road along the western side of the property and additional improvements consisting of stormwater management, lighting and landscaping on premises known as Block 76, Lots 30.01 and 32.01, Kent and Church Roads.

b.       Case No. SP-1034A / Gutierrez Properties, LLC

                     i.         Type:  Preliminary and Final Major Site Plan with Ancillary Variance & Design Waiver Relief

                   ii.         Description:  Application of Gutierrez Properties, LLC as Applicant and Owner seeking approval to store new shipping/storage containers on site in specified areas.  Each storage container is approximately 40 feet long x 8 feet wide x 8.5 feet high and will be stacked 2 or 4 containers high.  In total approximately 260 containers are proposed and will be stored on an existing gravel pad.  No additional site or building improvements are proposed on premises known as Block 49, Lot 21.01, 219 Squankum Road.

11.    Applications before the Board:

a.       Case No. SD-3013 Besadar, LLC – THERE WILL BE NO TESTIMONY ON THIS APPLICATION

                       i.       Type:  Preliminary Major Subdivision with Ancillary Variance & Design Waiver Relief

                      ii.      Description:  Application of Besadar, LLC as Applicant and Donald & Midred Geib as Owners seeking approval to clear 2.12 +/- acres of wooded area, remove all existing improvements except for the dwelling and driveway to subdivide the existing tract into seven total lots and construct a new public road with a cul-de-sac.  Proposed lots 1 through 6 will all have a new 2-story, 40 ft by 50 ft. dwellings with associated asphalt driveway, concrete walk, well, and 25 ft by 50 ft septic system in the front yard.  Proposed Lot 7 will satisfy the ARE-2 Open Lands subdivision requirement and will be 9.19 acres in size and contain the existing dwelling and open space for farming. Stormwater management will be addressed by two (2) hydraulically connected aboveground basins, one located in lot 1 and the other in lots 6 & 7.  Additional improvements include fencing around the basins, street signage, landscaping and lighting on premises known as Block 76, Lots 33 & 34, 57 Church Road.  This application was partially heard on September 5, 2024 when it was carried to October 17, 2024 with no further notice.  On October 17, 2024 it was carried to November 7, 2024 with no further notice and on November 7, 2024 it was carried to December 19, 2024 with no further notice.  On December 19, 2024 this application was carried to January 2, 2025 with no further notice for scheduling purposes only.

                    iii.      Expiration Date:  February 28, 2025

b.       Case No. SP-1127 / Diversified Acquisitions, LLC - THERE WILL BE NO TESTIMONY ON THIS APPLICATION

i.   Type: Preliminary & Final Major Site Plan with Ancillary Variance & Design Waiver Relief

ii.    Description:  Application of Diversified Acquisitions, LLC as Applicant and 940 Hwy. 33 East, LLC as Owners seeking approval to remove all existing improvements and perform tree clearing to construct two (2) flex space buildings with loading spaces with overhead doors, parking, EV charging spaces, concrete walks, trash enclosures, 3 aboveground infiltration basins, a water tank and pump house, retaining walls, pylon sign, curbing, ADA curb ramps, landscaping and lighting on premises known as Block 168, Lot 11.01, 940 Route 33.  This application was scheduled to be heard on October 17, 2024 when it was carried to November 7, 2024 with no further notice.  After some testimony on November 7, 2024 this application was carried to December 19, 2024 for scheduling purposes only, with no further notice.  On December 19, 2024 this application was carried to January 2, 2025 with no further notice for scheduling purposes only.

iii.  Expiration Date:  February 28, 2025

c.        Case No. SP-1123 / SMC Properties, LLC - THERE WILL BE NO TESTIMONY ON THIS APPLICATION

                       i.       Type:  Preliminary and Final Major Site Plan with Ancillary Variance and Design Waiver Relief

                      ii.      Description:  Application of SMC Properties, LLC as Applicant and Owner seeking approval to construct a one-story, 19,984 sf building containing eight (8) separate units with garages providing office and warehouse space for use as trade contractor businesses.  They are proposing 72 parking spaces to the west and east of the building with eight (8) concrete driveways for access to the garages.  Additional site improvements consist of concrete sidewalks and curbing, lighting, landscaping, one (1) aboveground stormwater management basin, one (1) new monument and eight (8) façade signs, and two refuse enclosures on premises known as Block 183, Lot 22, 985 State Route 33.  This application was originally scheduled to be heard on July 18, 2024 when it was carried to September 19, 2024 with no further notice.  It was carried again on September 19, 2024 to November 7, 2024 with no further notice.  On November 7, 2024 it was carried to December 19, 2024 with no further notice.  After some testimony on December 19, 2024 this application was carried to January 2, 2025 with no further notice for scheduling purposes only.

                    iii.      Expiration Date:  January 31, 2025

                    iv.      Eligible Voters:  Greenfield, Mercer, Wrubel, Fischer and Karbownik
